7. User-Generated Content and Prohibited Content

Vyzor AI strictly prohibits the creation, upload, or distribution of the following types of content through our Services:

  • Pornographic or sexually explicit content: Including but not limited to nudity, sexual acts, or any content intended to be sexually gratifying
  • Deepfakes: Realistic AI-generated depictions of real individuals without their explicit, verifiable consent, including but not limited to face-swapping, voice cloning, or motion transfer applied to real persons for deceptive or harmful purposes
  • Non-consensual intimate imagery: Any intimate or sexual depiction of a real person created without their consent
  • Child sexual abuse material (CSAM): Any content depicting or suggesting the sexual exploitation of minors
  • Content promoting violence, terrorism, or illegal activity
  • Hate speech or content targeting protected groups

7.1 Content Moderation and Automated Filtering

Vyzor AI employs automated content moderation systems, including AI-based safety filters, to detect and prevent the creation of prohibited content. These systems may scan uploaded images, videos, and prompts before, during, or after processing. While we strive for accuracy, no automated system is perfect, and we reserve the right to review and remove content at our discretion.

7.2 Account Suspension and Bans

Users who violate our content policies are subject to immediate account suspension or permanent ban, at Vyzor AI's sole discretion. Violations may result in:

  • Immediate removal of the offending content
  • Temporary suspension of account access
  • Permanent termination of account with no refund
  • Reporting to relevant law enforcement authorities where required by law or deemed necessary to protect public safety
  • Forfeiture of all remaining credits and subscription benefits

7.3 Disclaimer of Responsibility for User-Generated Content

Vyzor AI is not responsible for content created by users through our Services. Users are solely responsible for the content they create, upload, share, or distribute using the platform. Vyzor AI acts as a technology provider and does not endorse, verify, or assume liability for any User-Generated Content. By using our Services, you acknowledge and agree that:

  • You are solely responsible for all content you create, upload, or generate using our Services
  • You will not use our Services to create content that violates any applicable law or regulation
  • You will not use our Services to infringe upon the rights of any third party
  • Vyzor AI bears no responsibility for how you use, distribute, or share content generated through our platform
  • You assume all legal liability for content you create and its subsequent use

8. Voice Clone and Audio Data

8.1 Voice Data We Collect

When you use our Voice Services (voice cloning and text-to-speech), we collect and process the following additional data:

  • Audio samples: Voice recordings you upload for the purpose of creating a cloned voice model
  • Cloned voice models: Synthetic voice representations derived from your uploaded audio samples
  • Text inputs: Text you submit for text-to-speech generation
  • Generated audio: Synthetic speech produced by Voice Services
  • Voice usage metadata: Character counts, model selections, generation timestamps, and usage statistics
  • Speech history: Records of text-to-speech requests, including input text and associated metadata

8.2 How We Use Voice Data

Voice data is processed for the following purposes:

  • Creating and storing cloned voice models at your direction
  • Generating synthetic speech from your text inputs
  • Tracking usage against your subscription limits
  • Enforcing our Terms of Service and content policies
  • Detecting and preventing misuse of Voice Services, including unauthorized voice cloning and fraudulent use
  • Complying with applicable laws, regulations, and legal processes

8.3 Voice Data Sharing

Your audio samples and cloned voice models may be transmitted to third-party AI service providers for the purpose of processing your voice clone and text-to-speech requests. These providers process your data in accordance with their own privacy policies and data protection agreements we maintain with them. We do not sell voice data to any third party. We may disclose voice data to law enforcement authorities if required by law or if we believe in good faith that such disclosure is necessary to prevent fraud, criminal activity, or harm to individuals.

8.4 Voice Data Retention and Deletion

  • Active accounts: Cloned voice models and speech history are retained for as long as your account is active and your Voice subscription is current
  • Cancelled subscriptions: Cloned voice models are preserved for 30 days after cancellation to allow for resubscription, after which they may be permanently deleted
  • Terminated accounts: All voice data, including cloned models, audio samples, and generated speech, will be deleted within 30 days of account termination, except where retention is required for legal compliance, enforcement, or ongoing investigations
  • Uploaded audio samples: Original audio files you upload for cloning may be retained for up to 90 days for quality assurance and abuse prevention, after which they are automatically purged
  • Upon request: You may request deletion of your voice data at any time by contacting [email protected]. We will process such requests within 30 days, subject to legal retention obligations

8.5 Your Consent and Representations

By uploading audio samples to Voice Services, you represent and warrant that:

  • You are the person whose voice is contained in the audio sample, or you have obtained explicit, informed, written consent from the voice owner to upload their voice for cloning purposes
  • You understand that the audio will be processed by third-party AI systems to create a synthetic voice model
  • You will not upload audio containing voices of minors (persons under 18)
  • You accept full responsibility for any consequences arising from the creation and use of cloned voices

9. How and Where Do We Store Your Data?

We only keep your data for as long as we need to use it as described above in section 6 and/or for as long as we have your permission to keep it. In any event, we will conduct a review when appropriate to ascertain whether we need to keep your data. Your data will be deleted if we no longer need it in accordance with our Data Retention Policy.

8.1 Data Retention Policies

  • Your data will be deleted within 30 days upon request
  • As a customer of Vyzor AI, your data will be inaccessible to use if you do not use our application for a period longer than six months
  • Subscriber data will be immediately removed upon clicking "Unsubscribe" at the bottom of any email sent from our company or upon manual request
  • Account data will be retained for as long as your account is active and for a reasonable period thereafter to comply with legal obligations
  • Content moderation records and data related to policy violations may be retained for a longer period as necessary for legal compliance and enforcement

8.2 Data Security

Data security is of great importance to us, and to protect your data, we have put in place suitable physical, electronic, and managerial procedures to safeguard and secure data collected through our site. We use industry-standard encryption, secure servers, and access controls to protect your information.

Notwithstanding the security measures that we take, it is important to remember that the transmission of data via the internet may not be completely secure and that you are advised to take suitable precautions when transmitting data via the internet to us.

  • Google OAuth: For authentication
  • Third-party AI providers: For AI video, image, and voice generation (your prompts, images, audio samples, and generated content may be processed by these services in accordance with their respective privacy policies)
  • Sentry: For error tracking and application monitoring

9.2 Statistics and Analytics

We may compile statistics about the use of our Site, including data on traffic, usage patterns, user numbers, sales, and other information. All such data will be anonymized and will not include any personally identifying information. We may, from time to time, expand or reduce our business, and this may involve the sale and/or the transfer of control of all or part of our business. Data provided by users will, where it is relevant to any part of our business so transferred, be transferred along with that part, and the new owner or newly controlled party will, under the terms of this Privacy Policy, be permitted to use the data for the purposes for which it was originally collected by us.
